Terms of sale

These general terms govern the use of the blushfloral.fr website and the sale of floral products and services offered by Blush Floral Designer (Stéphanie Robbe). Any order implies full acceptance of these terms.

1. Products and services

Blush Floral Designer offers floral arrangements, bouquets, bespoke creations and event services (weddings, yachts, events). As flowers are natural and seasonal products, delivered arrangements may slightly differ from the photographs, which are non-contractual.

2. Orders and quotes

Bespoke creations and event services are subject to a personalised quote. The order is firm once the quote has been accepted in writing and, where applicable, the stated deposit has been paid.

3. Flower availability and substitution

To ensure the widest choice of flowers and varieties, we recommend ordering at least 48 hours in advance.

As flowers are fresh and seasonal products, certain varieties may occasionally be unavailable depending on supply, growing conditions or the season. In that case, Blush Floral Designer undertakes to offer flowers of equivalent quality, colour and style, respecting the spirit of the chosen creation.

For last-minute or same-day orders, Blush Floral Designer does its utmost to meet the request; where certain varieties are unavailable, equivalent alternatives may be proposed from the fresh flowers available. The client is then invited to trust the studio's creativity to achieve a harmonious creation true to the Blush Floral Designer style.

If the proposed substitutions do not suit the client, they may cancel the order and obtain a full refund before it is prepared.

4. Prices

Prices are shown in euros and net of tax — VAT not applicable, Article 293 B of the French General Tax Code. Any delivery charges are stated before the order is confirmed.

5. Payment

Payment is made by credit card, at the time of order. For event services, a deposit may be required at the time of order, with the balance due before the service is provided.

6. Delivery

Deliveries are made to Nice, Cannes, Monaco, Saint-Tropez and the French Riviera. Times and slots are agreed at the time of order. Blush Floral Designer cannot be held liable for a delay attributable to the recipient (absence, incorrect address) or to force majeure.

7. Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised, nor to goods liable to deteriorate or expire rapidly — which is the case for fresh floral arrangements. Consequently, orders for fresh flowers and personalised creations cannot be withdrawn.

8. Complaints

Any complaint relating to an order must be sent as soon as possible to stef@blushfloral.fr, with a photograph where possible. The perishable nature of flowers requires reporting on the day of receipt.

9. Consumer mediation

In accordance with Article L612-1 of the French Consumer Code, consumers may use a consumer mediator free of charge to resolve a dispute amicably. [TO BE COMPLETED: details of the consumer mediator the business has joined]

10. Liability & intellectual property

Blush Floral Designer's creations remain its intellectual property. Use of the site must comply with its intended purpose; any fraudulent use or use contrary to public order is prohibited.

11. Personal data

Data processing is described in the privacy policy.

12. Governing law

These terms are governed by French law. Failing an amicable resolution, any dispute shall fall under the jurisdiction of the competent French courts.
